After weeks of confusion, the town of Ladysmith has clarified its residential garbage container rules, confirming that bins up to 77 litres (20 gallons) and 22 kilograms (44 pounds) will be accepted for curbside pickup.
The update follows numerous complaints in August from residents whose garbage was suddenly left uncollected or stickered as non-compliant, despite no changes to their bins.
According to the town, the disruption began when Waste Connections, the municipality’s waste collection provider, started enforcing the town’s bylaw limit of 70 litres per container. That bylaw had technically been on the books for years but had not previously been enforced. However, the agreement between the town and Waste Collections stipulates that they will collect bins up to 77 litres and 22 kilograms.
“This was not a request from the town, but rather an operational change by Waste Connections that was not communicated to the town in advance,” said Nicholas Pescod, Ladysmith's communications and engagement specialist.
The move blindsided many residents, some of whom had been using the same bins for years without issue.
“We understand the frustration and confusion residents have experienced with garbage collection in recent weeks and sincerely apologize for the inconvenience,” Pescod said in a Sept. 3 media release.
Following discussions, Waste Connections agreed to stop enforcing the bylaw and instead follow the terms of its service agreement with the town.
“After lengthy discussions, Waste Connections has confirmed with the town that their operators will follow the terms of the agreement, which allow one bin up to 77 litres (20 gallons) in size that weighs no more than 22 kilograms (44 lbs). The town cannot guarantee that larger bins will be collected and strongly urges residents to comply with the size and weight restrictions of one 77 litre bin weighing no more than 22 kilograms,” Pescod said.
The Town of Ladysmith website has been updated to reflect the container sizes allowed under the agreement. In addition, the town says it will amend the Garbage, Recycling and Organics Collection Bylaw to bring it in line with the service agreement.
Residents are advised to check the size of their bins and ensure they do not exceed 77 litres or 22 kilograms when full.
“We are aware that some residents have bins larger than 77 litres and that Waste Connections has been collecting these bins. While Waste Connections may choose to continue collecting these bins, especially if they weigh less than 22 kilograms, it is at their discretion,” Pescod said.
Residents who require additional garbage disposal can purchase extra bin tickets from City Hall or the Frank Jameson Community Centre. Tickets are $3 each or six for $15, and any additional bins must still meet the 77-litre and 22-kilogram limits.
